INSURANCE CLAIMS  EXAMINATION

 EXAM 1  

1.  You are the adjuster and have just received  a bodily injury claim from your supervisor. The facts are as such. Mrs. Salazar was a passenger in a 1987 Toyota Cressida driven by her husband, Ezequiel Salazar.  The Toyota was northbound on US highway 50/83 in the right lane traveling at approximately 50 mph. The posted speed limited on US highway is 55 mph.  As the Salazar vehicle proceeded northbound, Christopher Jones, driving a Mazda, eastbound on Schulman Street, ran the stop sign striking the Mr. Salazar's vehicle.  Mr. Jones asserts his brakes had failed as a defense. The damage to the Salazar vehicle presents clear evidence that Mr. Jones was traveling at an excessive speed. 

 The force of impact caused significant left front end damage generating enough forced of energy to rotate the Salazar's vehicle counterclockwise 180 degree and while at the same time shoving the vehicle approximately 60-ft. in a northeasterly direction.  

Mrs. Salazar was not wearing her seat belt and sustained injuries to her knee, right shoulder, neck and head. At the time of the accident, Mrs. Salazar knees hit the dash as she was thrown forward from the impact. Mrs. Salazar has had surgery on this knee before as a result of a slip and fall in a Wal- Mart Store, which may have been aggravated as a result of Mr. Jones striking the vehicle that Mrs. Salazar was a passenger. Mrs. Salazar may have to have surgery again. She is now undergoing rehabilitation therapy.

Mr. Salazar was arrested because he had alcohol on his breath according to the investigating officer. This is all the information we have at this time.     

 EXAMINATION 1

 Question 1

a.  Discuss  and define  ALL  theories of Negligence  on the part of

1.      Mr. Salazar

2.      Mr.  Jones

3.      The Mazda  Manufacturer   

 Question 2

a. . What is Risk Utility and how would Mazda use this as a defense?

 Question 3.

 How would “ Sight and Aggravated  Negligence”  be attributed to   the following if any?

  1. Mr. Salazar
  2. Mr. Jones
  3. The Mazda Manufacturer./ or repair shop .

Question 4.  Define what is a motion for a Direct Verdict?  Provide an example  how it could be used  based on  this accident .

Question 5.  Define RES ISPA LOQUITER   and how would it relate to Mr. Jones and the manufacturer, if any? .    

 Question 6.  Define Exclusive Control Rule  and how can, if any,  it apply to the Mazda manufacturer?  

Question 7.  Define  “But For Cause” pg. 414.  Could Mr. Salazar’s drinking be attributed to this rule. .if yes , why ? if no, why not?    

Question 8.  Discuss the theory of joint and several liability and how this will affect Mrs. Salazar’s recovery from Mr. Jones. Pg. 422.

Question 9.  Mr. Jones’s insurance company wants to assert the seat belt rule as a defense.    Discuss the insurance company’s argument that may apply.   Chapter 11 

Question 10. What theory can Mr. Jones’s insurance company assert on Mrs. Salazar for riding in the vehicle knowing Mr. Salazar had been drinking.
