THE MARTINEZ FORMULA

IS AN UNIVERSAL FORMULA FOR ALL ATTORNEYS, COURTS,  INSURANCE COMPANIES,

ADJUSTERS, ACTUARIES AND UNDERWRITERS TO USE WHEN CALCULATING PAIN/ SUFFERING

 

                                                                             PERMANENT PAIN/ SUFFERING

                            Formula I                                                              MALE

                            Age - life expectancy X 365 ) = remaining  days of life expectancy X dollar amount =  pain and suffering 

                            Example:  30 - 80 LE = 50 yrs. X 365 = 18,250 days life expectancy  X $__________  = pain/ suffering

                                                                                             PAIN/ SUFFERING FULLY RECOVERED

                                      Formula II                                                          MALE

                            Date of injury minus date of recovery =  total number of calendar days  X dollar amount = pain/suffering

                            Example:   01/20/2011  minus 03/20/2012 = 425 calendar days   X  $_________= pain/suffering   

                            If pain medication allows the person to perform daily essential life activities, then, the amount per day is reduced.  

                            Example:  Pain medication for a broken leg reduces the pain, but does not permit the person to walk .

                                             Therefore, no reduction in the amount per day.

                                                                                                                                                                                          

                                        *** Note in  formula II,  age is not a factor  since pain does not favor a person's age.

                                               Formula I, II    PAIN means "hurt"  SUFFERING  means "the inability to perform

                                                              daily  essential life activities due to the impedance of pain".  Defined  by [Dan Martinez]

                                                     *** Pain/Suffering has nothing to do with calculating the loss of enjoyment of life  or employment . That  is a  different formula.
